TERMS AND CONDITIONS OF SALE

This e-commerce solution is managed by PRO MUSIC SRL, headquartered in Vezzano sul Crostolo (RE).

By using the services offered by this website, you accept these terms and conditions.

If you do not accept even a single part of this agreement, it will not be possible to continue the booking process.

(A) Acceptance of the order

The purchase of the requested items will be processed through the following phases:

By placing an order, the customer sends to PRO MUSIC SRL a purchase proposal for the selected product or products (photographic images of the products are for illustrative purposes only, refer to literal descriptions of products or ask information by writing or calling before sending the order). By sending the purchase order you agree, according to Art. 10 D.Lgs. 185/1999, to receive communications from PRO MUSIC SRL as described below, with the only intent of concluding and carrying out the sales contract.

PRO MUSIC SRL will send an email confirming the order receipt, with the assignment of a ‘Customer Order Number’, which needs to be used in any following communication with PRO MUSIC SRL.

The customer has 24 hours since the placement of the online order to communicate to PRO MUSIC SRL an eventual cancellation, by sending an email to the address ordini@promusicstore.it.
Cancellations made after the consignment imply the payment of delivery and collection fees.

If the order can be accepted, PRO MUSIC SRL will then send an e-mail confirming the conclusion of the purchase process, including information concerning the conditions of sales (art. 4 DL 185/1999).

PRO MUSIC SRL will then consign the product to the courier responsible for carrying out the delivery to the given address. The payment will be made by the customer using the method chosen on-line at the time of purchase.

(B) Payment methods

PRO MUSIC SRL allows customers to pay by credit card (Visa and Mastercard), relying on the safe technical structure of Banca Sella; by bank transfer, postal order or PayPal. In case of collection of the goods directly at our warehouse, it is possible to pay by cash, credit card or cheque.

After verifying the actual availability on stock of the ordered goods, PRO MUSIC SRL will deliver the purchased products to the courier as quickly as possible within 3 working days after the order confirmation. The courier will deliver the purchased goods within the next 72 hours (*) to the address specified by the customer when ordering. Delivery costs are charged to the client and are specifically mentioned in the page called “Shopping Cart” and in the final confirmation page. The goods travel at the addressee’s risk.

(D) Return and Refund Policy

The client can exercise the right of withdrawal according to D.Lgs. 185/99.
You can ‘withdraw without penalty’ and without giving any justification by sending a registered letter to PRO MUSIC STORE within ten working days from the date of signing the contract. As required by law, the purchaser cannot exercise the right of withdrawal once the sealed products have been opened.

(E) Complaints

Any eventual complaint must be addressed to the Returns Manager of PRO MUSIC SRL, Via G. Di Vittorio, 1 – Vezzano sul Crostolo (RE).

(F) Applicable Law

The sales contract between the customer and PRO MUSIC SRL is concluded in Italy and governed by Italian law.

(G) Privacy Policy

Dear Client, you can freely enter and visit the online store promusicstore.it and view products and prices, you can receive a cart to temporarily store the selected products and use the basic services without providing your personal information.
In order to buy you will have to register into our community providing your personal details and giving the consent to handle them according to D.Lgs. 196/2003. In particular, we will ask for an e-mail account where you will receive all the communications regarding your order.
Promusicstore.it guarantees that any information provided for promotional purposes will be treated according to D.Lgs. 196/2003. Promusicstore.it – Pro Music Srl also informs that, according to D.Lgs. 196/2003, the user’s personal details provided at the time of purchasing the goods and/or at the compilation of the invoice are excluded from the customer’s consent, according to the fiscal/tax requirements requested by law and European regulations and legislation (Art. 24, Let. A and B, D.Lgs. 196/2003).

(H) Request for personal details removal

Personal details are collected for the purpose of registering the customer and activate the procedures for the execution of the contract and the necessary communications; these details are electronically processed in accordance with law and can be given out only due to authorities’ request. According to Art. 7 D.Lgs 196/2003, Customer’s rights are: possibility of requiring confirmation of the existence of his personal details at Pro Music Srl offices, possibility of knowing the origin, logic and purpose of their handling; possibility of obtaining the updating, correction, and integration; possibility of requiring the cancellation or transformation into anonymous form; possibility of details blocking in case of unlawful handling; possibility of opposing their use for legitimate reasons or for marketing purposes. In order to obtain the cancellation of personal details, the customer needs to submit a written communication via fax (0522/602624) or mail to the company headquarters.
